Dutch Council of State to Rule on Gouda’s Temptation Lounge License Revocation

The Administrative Jurisdiction Division of the Dutch Council of State will deliver its verdict on June 25, 2025, regarding the revocation of the operating license for the Temptation Lounge in Gouda. The mayor revoked the licenses in July 2020 after a cash center and hashish were discovered on the premises.

What are Cash Centers?

Cash Centers are terminals found in various locations in the Netherlands. These terminals accept cash in exchange for access to certain services. For example, users can purchase phone cards and vouchers with cash at Cash Centers.

The primary function of a Cash Center is usually as a payment terminal, but they are also used to provide access to online gambling for cash. The websites offering gambling for cash typically lack a license from the Dutch Gaming Authority (Ksa) and are therefore illegal in the Netherlands.

Account creation and depositing funds occur through the Cash Center. Once an account is created, the Cash Center prints a ticket with the username and password.

The decision to revoke the operating license, as well as the alcohol and catering license, of Temptation Lounge was based on an administrative report highlighting serious irregularities. The report was prepared as part of the national criminal investigation ‘Kassa’ by the Dutch Gaming Authority (Ksa).

During a search of the premises in March 2019, police found a cash center that facilitated illegal gambling. A plastic bag containing 9.7 grams of hashish was also discovered. These findings prompted the mayor of Gouda to close the shisha lounge Temptation Lounge in 2019 for nine months, citing Article 13b of the Opium Act and Article 2:17, paragraph 1, of the Gouda General Local Ordinance 2009.

Mayor Revokes Operating License

In July 2020, the decision was made to revoke both the alcohol and catering license and the operating license. The owner of Temptation Lounge objected and appealed to the court in The Hague. The court ruled that the mayor was justified in revoking the licenses.

However, the owner of the Gouda establishment did not accept the ruling of the court in The Hague and appealed to the Council of State. The Administrative Jurisdiction Division of the Council of State heard the case on May 9, 2025, and will issue a ruling on June 25 regarding whether the licenses were rightfully revoked, according to the Council of State’s website.
