Brazilian Court Orders Approval of Another Online Betting Operator

The Secretariat of Prizes and Bets (SPA) in Brazil has been compelled by a court order to authorize a seventh company to offer online betting services within the country. This decision follows a ruling by the Federal Court.

Federal Judge Sergio Wolney de Oliveira Batista Guedes issued an injunction that mandates the SPA to grant authorization to Atlantis Comercio Eletrônico e Software House Ltda, along with its associated brands MetBet, EsportivaBet, and MetGol 100%.

The company believes it has secured provisional authorization for the adaptation period spanning from October 1st to December 31st, 2024. Atlantis submitted its license application before the initial preference window deadline of August 20th.

Submitting the application before the August 20th deadline ensured that Atlantis’s request would be processed before the legal online market’s launch on January 1st of this year.

The judge stated that the company received no communication from the SPA other than a request for additional documents on January 17th. This indicates that Atlantis’s application was not processed by the December 31st, 2024 deadline.

Consequently, the court has authorized Atlantis to offer online betting on a provisional basis until its license application undergoes evaluation.

Court Orders Allow Seven Betting Companies to Operate in Brazil

This latest ruling brings the total number of companies authorized to operate in Brazil through court orders to seven, encompassing 19 brands. In addition, there are 14 fully licensed operators and 56 others with provisional authorization.

Among the brands authorized by the courts to conduct business—pending the processing of their license applications—are Sportsbet.io, MegaPix.bet, and Aposta Online. Perhaps the most prominent company authorized by court order is Esportes Gaming Brasil and its brands Esportes da Sorte and Onabet.

Esportes da Sorte was allegedly operating illegally in Brazil from January 1st, following the expiration of the SPA’s transition period. The regulatory body rejected the operator’s license application due to allegations stemming from “Operation Integration.” This operation linked the company to illegal gambling and money laundering, leading to the arrest of its owner, Darwin Henrique da Silva Filho, and his wife.

However, a preliminary injunction from the Federal Court in January cited Article 5 of the Brazilian Constitution, which clarifies that “no one shall be considered guilty before a final and unappealable criminal conviction.”

As no criminal conviction has been issued to date, the Federal Court approved Esportes da Sorte’s request for authorization to operate nationwide. The decision also ensures that the SPA cannot impose additional barriers to its operations unless a conviction is handed down.
